Company reserves the right to modify or terminate this warranty at any time without prior notice. Any modifications or terminations will not affect warranty claims filed before the effective date of such changes.

Design & Printing Services

1. New Design

1.1. Working files are not provided unless specifically stated in the service description.

 

1.2. Design works can only be edited twice, any amendment completed will be regarded as 1 revision, and an additional fee of RM50+ will be charged for any subsequent edits.

 

1.3. The standard service period is one month unless it is a specially designed project that offers a different service period as stated in the service description.

 

1.4. Services and deliverables are exclusively limited to the agreed service period.

 

1.5. All terms and conditions are subject to our company’s discretion and may be modified or updated without prior notice.

2. Edit/Amendment

2.1. Amendments are limited to one occurrence only. An additional charge of RM50+ will be applied for each subsequent amendment.

 

2.2. Amendments are adjusted only on the request in the description. Any request other than it will be charged accordingly.

 

2.3. All terms and conditions are subject to our company’s discretion and may be modified or updated without prior notice.

3. Printing Products

3.1 Please carefully check the goods upon receipt. If you find any damage to the goods, please contact us immediately within 24 hours. We will verify the situation and take the necessary actions.

 

3.2. We do not offer the following warranty:

– Damage caused by misuse, abuse, negligence, or accidents.

– Normal wear and tear, cosmetic damage, or changes in appearance.

– Damage resulting from improper installation, maintenance, or unauthorised repairs.

– Damage caused by non-approved or incompatible accessories.

– Damage caused by exposure to extreme temperatures, humidity, or environmental conditions.

– Consequential, incidental, or indirect damages.

 

3.3. Company reserves the right to modify or terminate this warranty at any time without prior notice.

Any modifications or terminations will not affect warranty claims filed before the effective date of

such changes.

Facebook & Instagram Management Service

1. Workflow and Processing Time

1.1 Service period starts once the marketing plan is issued. New marketing plan for each service period will be released at the beginning of the new month. Kindly plan accordingly to receive the latest strategies and updates promptly.

 

1.2 Each social media post will be published on a weekly basis, subject to client approval & internal workflow.

 

1.3 Before publishing the post, we will send our work to the client for review. To ensure the project is on track, the client is required to respond within 24 hours and not latest by 48 hours.

 

1.4 Service period is monthly basic & operates on a subscription model, with a period of 30 + 10 days (grace period) after service period starts. If payment for the following month is not received before the current subscription ends, we reserve the right to terminate all our services, including incomplete progress for the previous month.

 

1.5 Proposed plan will be delivered within the period 1 month. If clients are not well prepared for the marketing campaign, both parties have the right to hold the project. Clients are recommended to be well-prepared before starting the project. Project on hold might affect the end results.

 

1.6 Clients are advised to follow at least 3 months of service to deliver the ideal results.

2. Enhanced Collaboration

Goal number provides a consensus on the goals agreed by both parties and a direction for the operation results. The actual results are subject to change.

3. Ad Campaign (Boosting) Cost Adjustments

Advertisement costs for ad campaigns (Boosting) will be adjusted accordingly based on advertising requirements.

4. Revision Policy

4.1 Graphic design & video editing includes up to two complimentary revisions, third time & onwards shall incur charges. The production team will proceed with the revisions once the additional amendment fee has been paid.

 

4.2 Major revisions require additional time, with a minimum of one full working day needed to complete any changes. Lead time may vary depending on the production team’s schedule and availability.

5. Add On Charges

5.1 Any revisions beyond the second will incur a minimum amendment fee of RM50 per adjustment.

 

5.2 Other ad hoc services are subject to add on charges.

 

5.3 Advertising management package does not include the creation of an ad account. A service fee of RM150 will be charged for creating an ad account. We recommend that customers ensure their ad account is in good standing before starting the service.

 

5.4 Urgent tasks requiring expedited handling, priority fee will be imposed. However, acceptance of “Priority” requests depends on our production team’s schedule availability.

6. Items Not Covered in Your Service Plan

Following services are not included in our package:

– Props

– Venue & set up for shooting

– Actor’s casting

– Customised animation

– Ads Campaign Budget

– Manual customer service message reply

7. Service Termination and Refund Responsibilities

Both parties are fully responsible in collaboration to deliver desirable marketing results. Either party may terminate the services upon written notice given to the other party. Refunds will not be provided under some circumstances. (Please refer to “Service Termination T&C”)

Photo & Video Shooting Service

1. Booking and Payment

1.1. 50% deposit is required to confirm booking, with the remaining balance due on the shoot day.

 

1.2. Deposits are non-refundable but transferable if rescheduled at least 7 days in advance.

2. Rescheduling and Cancellation

2.1. Rescheduling must be requested at least 7 days before the shoot.

 

2.2. Cancellations within 7 days of the shoot result in a forfeited deposit.

 

2.3. We reserve the right to reschedule in cases of emergency or unforeseen circumstances.

3. Scope of Services

3.1. This project includes all photography and video work as agreed upon, covering all specified shoot locations.

4. Services Excluded

4.1. This package does not include actors, 3D effects, any unlicensed stock footage or images, or voice-over services. Voice-over services are available at an additional cost if required.

5. Shoot Duration and Overtime

5.1. The project includes a set number of shoot days as per the agreement.

 

5.2. Delays caused by the client or related parties may incur additional charges at a full-day rate.

6. Delivery and Usage Rights

6.1. Final photos and videos will be delivered within 14 days after the shoot.

6.2. The client is granted commercial usage rights, but we retain copyright and may use materials for portfolio purposes unless otherwise agreed in writing.

7. Client Responsibilities

7.1. The client must provide necessary materials and instructions related to branding and visuals.

 

7.2. Client-caused delays may result in extra fees or reduced shoot time.

8. Liability

8.1. We are not responsible for any property damage or loss during the shoot.

 

8.2. The client agrees to indemnify us against any claims, damages, or expenses arising from the shoot.

9. Final Agreement

By confirming the shoot, the client agrees to these terms and conditions.

Refund Exceptions

1. Project Completed or Near Completion

No refund will be issued if the service or project has been fully or substantially completed, and the deliverables have been provided according to the agreement.

2. Early Termination of Service

If the client unilaterally terminates the contract or cancels the project before the end of the service period, any remaining service fees will not be refunded.

3. Failure to Adhere to Agreement Terms

If the client has not fulfilled their obligations under the contract (e.g., failing to make payments on time or provide necessary information and materials), no refund will be provided.

4. Delayed Payments or Outstanding Fees

If the client has any unpaid fees or has previously delayed payments, and these issues remain unresolved at the time of the refund request, no refund will be issued.

5. Unreasonable Service Complaints

Refunds will not be provided for claims based on unreasonable service complaints or dissatisfaction with the service results, as long as the agency has performed the services as outlined in the agreement.

6. Client Delays or Lack of Communication

If project progress is hindered due to client delays, lack of response, or failure to provide necessary cooperation, the agency will not issue a refund.

 

JNDesign Marketing Sdn Bhd aims to ensure a fair and smooth termination process, with due notice and mutual respect for any remaining obligations.

Service Termination

1. Breach of Contract

If a client violates any terms outlined in the service agreement, including failure to provide required materials or information, maintain confidentiality, or comply with outlined deliverables.

2. Non-Payment or Delayed Payments

In cases where a client consistently delays or defaults on payments despite prior reminders and grace periods (5 working days).

3. Scope Creep

If the project scope expands significantly beyond the originally agreed-upon terms without budget or time adjustments, the agency may issue a warning followed by termination if unresolved.

4. Unrealistic Expectations

If a client’s demands exceed the scope of services, setting expectations that are impractical or unrealistic, and these cannot be managed through renegotiation.

5. Legal or Ethical Violations

Should a client engage in illegal activities or unethical practices that risk the reputation or legal standing of the agency, services will be terminate immediately.

6. Poor Communication or Cooperation

If a client is consistently unresponsive, uncooperative, or fails to communicate effectively, making it difficult to deliver services as per the contract.

7. Strategic Business Decision

In cases where the client no longer fits within the agency’s business model or strategic direction, service termination may be considered.

Website Design & App Development

1. Scope of Work

The scope of work includes the design and development of a website as agreed upon between JNDesign Marketing SDN BHD and the client. This encompasses the creation of web pages, integration of features, and any other services outlined in the project proposal.

2. Review Sessions

One (1) review session will be provided for each web page design mockup. The client can provide feedback and request revisions during these review sessions. Additional review sessions may be subject to an additional fee.

3. Revisions

After the initial review sessions, any further revisions or changes to the design, functionality, or content of the website may incur additional charges. It is recommended that the client provides comprehensive feedback during the designated review sessions to ensure efficient progress.

4. Content Provision

The client is responsible for providing all necessary content for the website, including text, images, logos, and other media. Delays in content provision may affect the project timeline. Content should be provided in a timely manner to avoid project delays.

5. Project Timeline

The project timeline will be outlined in the project proposal. Any delays caused by the client, including late content provision, feedback, or approvals, may extend the project timeline. JNDesign Marketing SDN BHD will make reasonable efforts to meet the agreed-upon deadlines.

6. Payment Schedule

For projects with a total cost below RM10,000, a 100% upfront payment is required before commencement of the project. For projects with a total cost exceeding RM10,000, a 50% deposit is required before the project begins. The remaining 50% of the total project cost should be paid upon completion of the web page design to proceed with the website development.

7. Hosting

Our company package includes server hosting services. However, in cases where clients opt to use their own hosting provider and encounter website issues related to the server, it is the client’s responsibility to directly liaise with their chosen hosting service provider for resolution.

8. Yearly Renew & Maintenance

All package prices include the first year of management services. Additional charges will apply for any added web page designs and functionalities. Yearly Renew for the second year onwards will be billed based on the domain purchase date. The yearly renewal charges will adhere to the prices specified in the invoice. The company reserves the right to modify the update pricing.

9. Intellectual Property

Upon final payment, the client will have full ownership and rights to the website’s design and content. JNDesign Marketing SDN BHD retains the right to showcase the project in its portfolio and marketing materials.

10.Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project.

11.Legal Jurisdiction

Any disputes arising from this project will be governed by the laws of Malaysia. Both parties agree to resolve disputes through arbitration or mediation if possible.

Xiao Hong Shu Management Service

1. Project Timeline

Proposed plan will be delivered within the period 1 month.
We, service provider will liaise with all KOC / influencers, aiming to complete publishing within a one-month timeframe.

2. Service Period and Subscription Policy

Final Terms Service period is monthly basic & operates on a subscription model, with a period of 30 + 10 days (grace period) after service period starts. If payment for the following month is not received before the current subscription ends, we reserve the right to terminate all our services, including incomplete progress for the previous month or coordinate alternative solutions.

3. Service Termination and Refund Responsibilities

Both parties are fully responsible in collaboration to deliver desirable marketing results. Either party may terminate the services upon written notice given to the other party. Refunds will not be provided under some circumstances. (Please refer to “Service Termination T&C”)

4. Exceptions to the Publishing Timeline

Exceptions include:

  • On-Site Visit – If the merchant is unable to schedule an appointment for KOC within the prescribed time, leading to a delay in publication, this will be considered an exception.
  • Product Sponsorship – If the merchant is unable to provide the product to the KOC / influencer within the prescribed time, leading to a delay in publication, this will be considered an exception.
